LAND TAX ASSESSMENTS FOR THE FINANCIAL YEAR 2014/15
1.Newspaper reports inform that assessments for the payment of land tax in respect of 2014/15 have been or will be sent to landowners for payment by end October 2015.
2. These assessments are fatally flawed and completely deprived of a legal basis because
2.1 regulations dealing with such tax prescribe numerous steps to be taken, which was simply ignored;
2.2 the tax can only be based on the 2007 valuation roll which expired on the 31st March 2013;
2.3 regulation 16 states that
“The valuation roll is the basis upon which land tax is assessed under regulation 21(1)”.
3.The assessments are accordingly in law nullities and can be ignored.
4.LOAN will comply with land tax raised in accordance with the Constitution but objects to unconstitutional conduct.
